NumberSpinner アプリ 利用規約

NumberSpinner アプリ（以下「本アプリ」）の使用を開始する前に本利用規約をご確認ください。
本アプリをダウンロードまたは使用することによって、お客様は自動的に利用規約へ同意したものとみなします。

本アプリ自体、および本アプリに関連するすべての著作権、データベース権、その他の知的財産権は Polar Tech（以下「開発者」）に帰属します。
本アプリおよび本アプリの一部を、いかなる方法でもコピーまたは変更することは許可されていません。本アプリのソースコードを抽出することは許可されていません。また、本アプリを他の言語に翻訳したり、派生バージョンを作成したりしないでください。

開発者は本アプリが可能な限り有用かつ効果的なものとなるよう努めています。
そのため開発者は、いつでも、理由を問わずに、本アプリに変更を加えたり課金する権利を留保します。本アプリの課金について明確にお客様に伝えない限り、お客様への請求が発生することはありません。

本アプリでは、アプリの提供や改善のためにお客様から提供された個人情報を保存および処理します。お客様ご自身の責任で携帯電話とアプリへのアクセスの安全性を保つようにしてください。
そのために、携帯電話のジェイルブレイク（脱獄）やルート化は行わないことを推奨いたします。これらは携帯電話の公式OSによって課せられたソフトウェアの制限や制約を取り除く処理であり、お使いの携帯電話がマルウェア／ウイルス／悪意のあるプログラムに対して脆弱になり、携帯電話のセキュリティが侵害され、本アプリが正常に機能しないか、まったく機能しなくなる可能性があります。

開発者が責任を負わない事項があることにご注意ください。
本アプリの特定の機能では有効なインターネット接続が必要です。接続はWi-Fiまたはモバイル通信事業者によって提供されますが、Wi-Fiにアクセスできない、あるいはデータ通信容量が残っておらずそれらの機能が使えないことに対して開発者は責任を負いません。

Wi-Fiのあるエリア以外で本アプリを使用する場合、モバイル通信事業者との契約条件が適用されることにご注意ください。
その結果、本アプリ使用中に発生したインターネット接続およびデータ通信の料金、または他の第三者の料金についてモバイル通信事業者から請求される場合があります。データローミング機能をオフにせずに海外等（お客様のホームエリア以外の地域や国）で本アプリを使用する場合は、国際ローミング通信料などの責任を負います。
お客様が本アプリを使用しているデバイスの支払名義人でない場合、本アプリの使用について支払名義人から許可を得ていると想定していることにご注意ください。

同様に、開発者は本アプリの使用方法について常に責任を負うことはできません。
例えば本アプリを使用する際にバッテリー不足でデバイスの電源が入らないような場合、お客様ご自身でデバイスを充電する必要があり、開発者は責任を持ちません。

本アプリの使用および使用中おける開発者の責任に関して、常に最新かつ正確なものであるよう努めていますが、第三者による情報提供に依存した上で成り立っている点にご留意ください。
開発者は、お客様が本アプリに完全に依存した結果として発生した直接的または間接的な損失について一切の責任を負いません。

将来的に本アプリを更新することがあります。現時点で、本アプリはiOSで使用可能ですが、iOSのシステム要件（および本アプリでの対応拡大を決定した追加システムの要件）は変更される可能性があり、本アプリの使用を継続するには最新版をダウンロードする必要があります。
開発者は、お客様のデバイスにインストールされたiOSバージョンで動作するように本アプリを常に更新することをお約束しません。ただし、お客様は提供された更新を常に受け入れる必要があります。
また、事前の通知なしにいつでも本アプリの提供および使用を終了する場合があります。特に断りのない限り、終了時には（a）これらの条件でお客様に付与された権利とライセンスは終了し、（b）本アプリの使用を停止し、（必要な場合は）お客様のデバイスから削除されます。

利用規約の改定について

本利用規約を適宜見直し、必要に応じて改定する場合があります。
利用規約の改定は本ページの更新をもってお知らせしますので、定期的に確認されることを推奨いたします。
改定内容は本ページが更新された直後に有効となります。

NumberSpinner App Terms and Conditions

By downloading or using the app, these terms will automatically apply to you – you should make sure therefore that you read them carefully before using the app. You’re not allowed to copy, or modify the app, any part of the app in any way. You’re not allowed to attempt to extract the source code of the app, and you also shouldn’t try to translate the app into other languages, or make derivative versions. The app itself, and all the copyright, database rights and other intellectual property rights related to it, still belong to Polar Tech.

Polar Tech is committed to ensuring that the app is as useful and efficient as possible. For that reason, we reserve the right to make changes to the app or to charge for its services, at any time and for any reason. We will never charge you for the app or its services without making it very clear to you exactly what you’re paying for.

The NumberSpinner app stores and processes personal data that you have provided to us, in order to provide our App. It’s your responsibility to keep your phone and access to the app secure. We therefore recommend that you do not jailbreak or root your phone, which is the process of removing software restrictions and limitations imposed by the official operating system of your device. It could make your phone vulnerable to malware/viruses/malicious programs, compromise your phone’s security features and it could mean that the NumberSpinner app won’t work properly or at all.

You should be aware that there are certain things that Polar Tech will not take responsibility for. Certain functions of the app will require the app to have an active internet connection. The connection can be Wi-Fi, or provided by your mobile network provider, but Polar Tech cannot take responsibility for the app not working at full functionality if you don’t have access to Wi-Fi, and you don’t have any of your data allowance left.

If you’re using the app outside of an area with Wi-Fi, you should remember that your terms of the agreement with your mobile network provider will still apply. As a result, you may be charged by your mobile provider for the cost of data for the duration of the connection while accessing the app, or other third party charges. In using the app, you’re accepting responsibility for any such charges, including roaming data charges if you use the app outside of your home territory (i.e. region or country) without turning off data roaming. If you are not the bill payer for the device on which you’re using the app, please be aware that we assume that you have received permission from the bill payer for using the app.

Along the same lines, Polar Tech cannot always take responsibility for the way you use the app i.e. You need to make sure that your device stays charged – if it runs out of battery and you can’t turn it on to avail the Service, Polar Tech cannot accept responsibility.

With respect to Polar Tech’s responsibility for your use of the app, when you’re using the app, it’s important to bear in mind that although we endeavor to ensure that it is updated and correct at all times, we do rely on third parties to provide information to us so that we can make it available to you. Polar Tech accepts no liability for any loss, direct or indirect, you experience as a result of relying wholly on this functionality of the app.

At some point, we may wish to update the app. The app is currently available on iOS – the requirements for system (and for any additional systems we decide to extend the availability of the app to) may change, and you’ll need to download the updates if you want to keep using the app. Polar Tech does not promise that it will always update the app so that it is relevant to you and/or works with the iOS version that you have installed on your device. However, you promise to always accept updates to the application when offered to you, We may also wish to stop providing the app, and may terminate use of it at any time without giving notice of termination to you. Unless we tell you otherwise, upon any termination, (a) the rights and licenses granted to you in these terms will end; (b) you must stop using the app, and (if needed) delete it from your device.

Changes to This Terms and Conditions

I may update our Terms and Conditions from time to time. Thus, you are advised to review this page periodically for any changes. I will notify you of any changes by posting the new Terms and Conditions on this page. These changes are effective immediately after they are posted on this page.
